The services Ramsay Title
Group, LLC renders in connection with a typical commercial or industrial
real estate transaction are as follows:
- Our examination staff, made up of law
school graduates and lawyers, examine title to the real property
including the property over which appurtenant easements pass at the
county record room(s) in the county courthouse(s) in which the
property is located. Frequently, this examination involves the
probate records in the Probate Court, sometimes in other counties.
They also examine the UCC Records, General Execution Dockets (Judgements),
Federal Tax Lien Dockets, Lis Pendens Dockets, Miscellaneous Dockets,
Preliminary Lien Dockets and the Suit Index and the Suit or the Bench
and Bar Dockets. Also, they review the tax assessors maps and tax
assessment cards for other matters affecting the title to the subject
property. They either order a tax report from a tax service, if
available, or examine the taxes themselves if no tax service is
available. The State Bar Title Standards and the title insurance
underwriters require a certification period which covers at least 50
years back from the current date. Therefore, if we are furnished an
existing owners title insurance policy issued by a reliable agent that
insures the subject property or a tract which includes the subject
property, we can save time in our examination and therefore save money
for the client. Our examination staff has an average experience at
doing title examinations of approximately 25 years.
- After the raw title report and
copies of documents, plats, tax maps and tax reports come in from the
courthouse, our underwriting staff, all of whom are lawyers with an
average experience of approximately 25 years in this type of work,
review each title document, recorded plat, easement, agreement, etc.
and draft the title insurance commitment(s). If special problems
arise or special coverages are required, we make the underwriting
decisions to require curative work, set up as an exception or insure
over the problem. If the issue is outside our authority as agent,
then we discuss these issues with the underwriters in-house title
counsel. Frequently, we are asked to produce a 50 year owners list to
be used in conjunction with an Environmental Phase I study.
Occasionally, we are asked to produce a UCC certification letter for
the benefit of a lender. There is an extra chare for these services.
The title commitment(s) and copies of all requirement/exception
documents, together with certain information peculiar to Georgia real
estate conveyancing, is shipped to the person or persons we have been
instructed to furnish with commitments. We also send a copy of the
commitment and the back-up materials to the surveyor and work with him
to coordinate the title insurance and survey, if requested to do so.
- As the transaction progresses toward
the closing, we revise the commitment to include the information from
the new survey and review draft documentation with the purchaser's,
seller's and lender's attorneys.
- The closing usually will take place
in the offices of either purchaser's, seller's or lender's counsel and
someone from our office will attend the closing to review the final
documents, signatures thereon, and mark the commitments to put the
title insurance in force before the deeds leave the table. Usually
the funds are disbursed in accordance with the closing statement
through the trust account of the attorney in whose office the closing
occurs.
- Ramsay Title Group, LLC is frequently
asked to act as Escrow Agent to hold earnest money and post closing
escrows. These funds are disbursed upon joint instruction of the
parties to the Escrow Agreement. There is usually no charge for the
earnest money escrow if we write the title insurance. If we are asked
to disburse all of the closing funds there is an escrow charge.
- Ramsay Title Group, LLC records the
documents, does a post closing checkdown to make sure that all
requirements were met and all instruments were properly recorded and
indexed. Then we issue the final policy and ship the policies with
the original documents or copies to the appropriate attorney(s) so he
can deliver it to his client.
